Can a non-Saudi own real estate in Saudi Arabia?

Yes, in cases defined by law, but eligibility is not the same for everyone. It depends on your legal category, whether the property is inside or outside a designated geographic zone, the type of real right, and the controls in force.

Executive answer: separate three decisions

The law and implementing regulation

They define non-Saudi categories, baseline prerequisites, registration, selected exceptions, and the statutory fee.

The geographic-zone decision

It determines location, permitted real rights, maximum ownership percentages, usufruct duration, and controls within each zone.

Premium Residency policy

It independently determines eligibility for Real Estate Owner Residency. Permission to own is not an entitlement to residency.

Choose your legal status before choosing a property

Lawful resident

In addition to rights within designated zones, the law gives a lawfully resident non-Saudi natural person a route to own one property for their residence outside the designated geographic zones. Makkah and Madinah are excluded, and the other controls continue to apply.

Article 2(3) of the Law

Non-resident individual

Before owning real estate or acquiring another real right, a non-resident natural person must obtain an approved digital identity, open a Saudi bank account in their own name, and obtain a Saudi mobile number in their own name linked to that digital identity.

Foreign company

It must register with the Ministry of Investment under the approved procedure, disclose its direct and indirect owners, have a lawful representative with Saudi-issued identity, and open a Saudi bank account in the company name. A registration number follows satisfaction of the requirements, and specified changes trigger notification duties.

Article 3 of the Implementing Regulation

Saudi unlisted company with non-Saudi participation

This is not the foreign-company route. Outside a designated zone — excluding Makkah and Madinah — the regulated route is limited to business activities or employee housing and requires Ministry of Investment approval. Inside a designated zone, including Makkah and Madinah, the regulation provides a route without that approval, still subject to the law and zone controls.

Article 8 of the Implementing Regulation

Foreign non-profit or other legal entity

A foreign non-profit registers with the National Center for Non-Profit Sector, discloses direct and indirect controllers, appoints a lawful representative with Saudi-issued identity, and opens a Saudi bank account in its name before its registration number is issued. Another foreign legal person enters this route only when designated by a Council of Ministers decision with a competent authority.

Premium Residency holder or applicant

Other laws may provide better rights to a Premium Residency holder, but the ownership application and Real Estate Owner Residency application remain separate decisions. Check property eligibility under the ownership rules, then check the Center's product criteria.

Geographic zones: a location name is not enough

The law permits ownership or acquisition of real rights within zones designated by the Council of Ministers. The permitted right, maximum ownership percentage, maximum usufruct duration, use, and other controls may differ by zone. A project or district appearing on a map does not establish that a particular person or parcel satisfies the requirements.

Makkah and Madinah

For the general route within designated zones, the law limits ownership or acquisition of real rights in the two cities to a Muslim natural person. The resident's one-home route outside designated zones also excludes both cities. The route for a Saudi unlisted company with non-Saudi participation is separate and should not be reduced to the natural-person rule.

Practical ownership journey

  1. Classify your legal status: resident or non-resident individual, foreign company, Saudi company with non-Saudi participation, foreign non-profit, or Premium Residency holder.
  2. Verify the zone and right: check the exact parcel, real-right type, use, ownership percentage, or permitted duration on the official portal.
  3. Complete due diligence: verify the Real Estate Registry record or title, owner, mortgages and restrictions, planning, permitted use, and relevant licences.
  4. Meet identity and banking prerequisites: prepare the identity or entity registration, bank account, and source-of-funds material applicable to your category.
  5. Apply and pay lawfully: the regulation establishes an electronic portal linked to the Real Estate Registry and requires related financial transactions to use lawful electronic payment methods.
  6. Complete registration: ownership, other real rights, and title issuance are completed through the Real Estate Registry under its governing rules.

Important rules for families and companies

Family rule for the residential home

For the lawful resident's residential-property route, the regulation treats the non-Saudi's non-Saudi spouse and descendants as dependants. None may independently own a residential property under that rule unless the marriage ends or the descendant reaches age 25.

Do not merge the two company categories

A foreign company follows the registration, disclosure, identity, and banking requirements in Article 3. A Saudi unlisted company with non-Saudi capital participation follows Article 8, with different rules inside and outside designated zones.

What statutory fee applies to a non-Saudi's disposition of a real right?

Article 9 of the Implementing Regulation sets a 2% fee on the value of a non-Saudi's disposition of real rights in real estate in the City of Riyadh, City of Makkah, City of Madinah, and Jeddah Governorate. Its table covers all types of real rights and uses.

It is not a universal “2% purchase tax”

The legal concept is a fee on the value of the non-Saudi's disposition of the real right. Article 10 assigns a zero rate to stated dispositions, including those outside Article 9 and other listed cases. Confirm the classification and treatment of the actual transaction with the competent authority or independent adviser before calculating total cost.

Real Estate Owner Residency: ownership is not residency

Buying property does not automatically grant Premium Residency.

Real Estate Owner Residency is a separate Premium Residency Center product. The applicant must satisfy its general and product-specific terms and receive approval. The Center states that all conditions are subject to change.

Category 1: existing property

  • Ownership or usufruct of residential real estate in Saudi Arabia with a total value of at least SAR 4,000,000.
  • The property must not be mortgaged and must not subsequently be mortgaged.
  • Its use must be residential.
  • It must be an existing property, not developed or undeveloped land, under the currently published wording.

Category 2: off-plan unit

  • Purchase of one off-plan residential unit worth at least SAR 4,000,000.
  • Payment of at least SAR 1,000,000 or 10% of the property value, whichever is higher.
  • The developer must be approved by the General Authority for Real Estate (REGA).
  • No real-estate financing for the purchase and no mortgage after ownership transfers.

Can a foreign national buy real estate in Saudi Arabia?

The statutory category is “non-Saudi.” A non-Saudi may own or acquire a real right depending on legal category, zone, right type, and controls. There is no general answer guaranteeing eligibility for every person or parcel.

Can a lawful resident own a home?

The law provides a route for one residential property outside the designated zones, excluding Makkah and Madinah, in addition to what designated-zone rules may permit.

Can a non-resident buy?

No. The value threshold is one element of a separate product. All other general and product-specific conditions and the Premium Residency Center's approval remain necessary.

What are the off-plan Real Estate Owner Residency criteria?

One residential unit worth at least SAR 4 million; payment of SAR 1 million or 10%, whichever is higher; a REGA-approved developer; no real-estate financing; and no mortgage after ownership transfers, under the current terms.

How does a foreign company differ from a Saudi company with foreign participation?

The first is a foreign entity subject to Article 3 registration, disclosure, identity, and banking prerequisites. The second is an unlisted company established under Saudi company law and follows Article 8's different rules inside and outside designated zones.
